Three locks, three keys — and most operators grab the wrong one
You landed a job that needs you inside Class D airspace, over a crowded parking lot, or a half-mile down a pipeline you can't keep in sight. Now the search-bar panic sets in: Do I need LAANC? A waiver? A DroneZone authorization? All three? The words get used interchangeably online, but the FAA treats them as three distinct mechanisms — and filing the wrong one costs you days you don't have, or worse, launches a flight the FAA never actually cleared.
Flying in controlled airspace without §107.41 authorization is a certificate action, and the FAA can assess civil penalties of up to $27,500 (49 USC 46301). This guide draws the three lines cleanly, then shows you the one screen that tells you which key your flight needs before you file anything.
Airspace authorization (§107.41) vs waivers (§107.200) — the difference that matters
Airspace authorization (§107.41) is about where you fly. Part 107 lets you operate in uncontrolled (Class G) airspace with no permission at all. The moment your operating area touches controlled airspace — Class B, C, D, or the surface area of Class E — you need prior authorization from Air Traffic Control. You get it one of two ways:
- LAANC (Low Altitude Authorization and Notification Capability) — near-real-time authorization, often granted in seconds, for flights at or below the published grid ceiling on the FAA UAS Facility Map (UASFM) at your location. Grid ceilings range from 0 ft (no auto-approval) up to 400 ft AGL.
- FAA DroneZone "further authorization"— the manual path for flights above the LAANC grid ceiling, or where LAANC isn't offered. This is a formal request that takes days to weeks.
A waiver (§107.200) is about howyou fly. It's a Certificate of Waiver that lets you deviate from a specific operating rule when you can prove the operation is still safe. The FAA lists the waivable rules in §107.205 — the common ones are beyond visual line of sight (§107.31), operation from a moving vehicle or aircraft (§107.25), multiple aircraft by one pilot (§107.35), visual observer (§107.33), and yielding right-of-way (§107.37). Waivers require a written safety case and take weeks to months.
The trap: LAANC and a waiver are not substitutes. LAANC only opens controlled airspace at grid ceilings — it never grants BVLOS, over-people, or night privileges. If your job needs both (say, a BVLOS pipeline flight that also clips Class D), you need both the §107.41 authorization andthe §107.200 waiver. BVLOS (§107.31): the one that’s still a genuine waiver
Beyond visual line of sight is the clearest example of the waiver side of the line. Standard Part 107 requires the remote pilot in command (or a visual observer) to keep the aircraft in unaided visual line of sight at all times (§107.31). There is no category, no declaration of compliance, and no LAANC grid that gets you out of that requirement — the only path to a legal BVLOS flight under Part 107 today is a §107.200 waiver against §107.31, or an FAA-accepted BVLOS exemption/operating rule where one applies to your operation.
A BVLOS waiver application has to show the FAA an equivalent level of safety to keeping the aircraft in sight — typically through detect-and-avoid procedures, ground-based visual observers along the route, or technology that substitutes for the human eye. That's a written safety case, not a form, and it's reviewed on a timeline measured in weeks to months, not minutes. You probably don’t need a night waiver anymore
This one saves operators real time. Since the Part 107 update effective April 2021, routine night operations no longer require a waiver (§107.29). You may fly at night once you've completed the updated FAA training and your drone displays anti-collision lighting visible for at least 3 statute miles.
Operations over people were similarly restructured into Categories 1-4 under Subpart D (§107.110-§107.140): if your drone meets a category — Category 1 for aircraft 0.55 lb or less, Category 2 or 3 via the manufacturer's Declaration of Compliance (§107.160), or Category 4 with an FAA airworthiness certificate — you may not need a waiver against §107.39 at all. Operations over moving vehiclesare a related but separate rule (§107.145) with its own category-based conditions — don't assume clearing the over-people categories automatically clears a moving-vehicle operation. Getting these right means you file waivers only for what actually still requires one — chiefly BVLOS and edge-case operations — instead of paying weeks of review time for privileges the rules already grant you.
